In the draft rules of the Labor Code, there is a provision to include extra work between 15 and 30 minutes in overtime. Along with this, any employee has been prohibited to work continuously for more than 5 hours.

If the Modi government of the Center implements the rules of the Labor Code, then there will be a change in the rules from working hours to overtime. A proposal has been proposed to increase the maximum working hours to 12 in the new draft law. Along with this, there is a provision in the rules to include extra work between 15 and 30 minutes in overtime by counting 30 minutes. This can be of great benefit to the employed people.

Instructions have also been included in the draft rules to give half an hour interval to the employees after every five hours. According to the rules of the Labor Code, the basic salary should be 50 percent or more of the total salary. Due to this, there will be a change in the salary of most of the employees. If the basic salary increases, then the amount deducted in Provident Fund (PF) and Gratuity will increase. This will reduce the Take Home Salary.

With the increase in the contribution to the provident fund and gratuity, the amount received after retirement will also increase. With the increase in PF and gratuity, the cost of companies will also increase because they will also have to contribute more to the PF for the employees. This is bound to have an impact on the balance sheets of the companies as well. This is the reason why these rules have been deferred. These rules were to come into force from April 1, 2021, but due to lack of preparation of state governments and companies, they have been postponed. The Modi government wants to implement these rules as soon as possible.
