High court reprimanded Uttarakhand government, said – it is a crime to make employees work without pay

Nainital. In the matter of salary of roadways employees, the Uttarakhand High Court has ordered the central government to take a decision in the matter of assets by meeting both the states of Uttar Pradesh and Uttarakhand. The court also told the government that only two months’ salary is being received from the amount given by the government. The court asked the Chief Secretary of the state to take a decision in the cabinet and inform the High Court about it. During the hearing, the Chief Justice referred to Article 23, stating salary as a constitutional right of the employees, and said that wages or begari cannot be done without money.

When asked by the court why the full salary was not given, the officials cited the financial crisis and said that the board has decided that till the financial situation gets better, the employees will be given half the salary. The court reprimanded it and said whether it should be assumed that a financial crisis has arisen on the state, and whether the law or the constitution gives the right to take such decisions on the board. The court said that it comes under the category of offence.

During the hearing, the government told the court that an amount of Rs 34 crore has been released, so that salary for the month of April-May can be given. Expressing displeasure over this reply of the government, the court asked that what is the planning ahead, they should also tell the court.

Let us inform that the Roadways Employees Union has filed a petition in the High Court demanding payment of salary. It has been said in the petition that if they go on strike for salary, then the government takes action against them under ESMA. The Roadways Employees Union also said in the petition that the distribution of assets worth 700 crores is to be received from the Uttar Pradesh government. Along with this, the government has given the liability of 45 lakhs including Kedarnath disaster on the government.
